Envirosafe has been granted both an U.S. EPA (federal) and an Ohio Hazardous Waste Facility Board (state) Part B RCRA permits. Envirosafe's authority to operate as a TSDF is derived from both of these permits, with the more stringent of the two being applicable for various aspects of its operation. The state permit is generally more stringent in regard to specific processes the facility is permitted to carry out and their design capacities. Authority to handle certain EPA Hazardous Waste (HW) Numbers, specifically those that are newly identified, is derived from federal authority until such time as these codes are incorporated into the State of Ohio’s regulations. U.S. EPA "early terminated" all portions of the federal permit that were less stringent or redundant.

The State Part B Permit is divided into two sections with regard to processes and design capacities: Renewal and Expansion. The Renewal portion of the state permit continued essentially what was permitted under state (and federal) interim status, including the 90 original EPA HW Numbers and 38 additional EPA HW Numbers added by revision or Class 1 modification during the period of interim status.

The expansion, which is essentially Cell M and the area south of York Street, includes the processes and design capacities for the treatment building and landfill. Cell M’s total capacity is approximately 2.3 million cubic yards. The treatment process capacity is set by the permit at 150 tons per hour.
